This article examines five different Medical-Legal Partnerships associated with Yale Law School in New Haven, Connecticut to illustrate how MLP addresses the social determinants of poor health. These MLPs address varied and distinct health and legal needs of unique patient populations, including: 1) children; 2) immigrants; 3) formerly incarcerated individuals; 4) patients with cancer in palliative care; and 5) veterans. The article charts a research agenda to create the evidence base for quality and evaluation metrics, capacity building, sustainability, and best (...) practices; it also focuses specifically on a research agenda that identifies the value of the lawyers in MLP. Such a focus on the “L” has been lacking and is overdue. (shrink)

Specialists and primary care physicians play an integral role in treating the twin epidemics of pain and addiction. But inadequate access to specialists causes much of the treatment burden to fall on primary physicians. This article chronicles the differences between treatment contexts for both pain and addiction — in the specialty and primary care contexts — and derives a series of reforms that would empower primary care physicians and better leverage specialists.

Excessive prescribing of pain medications after surgery has contributed to the epidemic of opioid misuse and diversion in the United States. Pain specialists may be particularly well situated to address these issues. We describe an attempt to reverse the trend at an orthopedic surgical hospital by implementing a peri-operative assessment and treatment service which minimizes preoperative opioid use, when necessary implements addiction treatment, and encourages early tapering from opioids.

The devastating impact of the national opioid epidemic has given rise to hundreds of lawsuits. This article details the extremely broad range of legal claims, compares the opioid cases to other public health litigation efforts, including tobacco, and describes the special mechanism — a multidistrict litigation — through which more than 700 opioid-related cases have been consolidated thus far, with settlement almost certain to follow.

In 1999, Dan Zahavi’s Self Awareness and Alterity: A Phenomenological Investigation initiated a critique of the standard interpretation of the distinction between the second and third levels of Husserl’s analysis of time-constituting consciousness. At stake was the possibility of a coherent account of self-awareness (Zahavi’s concern), but also the possibility of prereflectively distinguishing the acts of consciousness (Brough and Sokolowski’s rebuttal of Zahavi’s critique). Using insights gained from Husserl’s Analyses Concerning Passive Synthesis rather than the work on time-consciousness, this paper (...) provides a new, more precise vocabulary in which to carry on the debate, in the hopes of bringing it to a mutually satisfactory resolution. After briefly laying out the terms of the Zahavi–Brough/Sokolowski debate (Sect. 2), I then elaborate a three-fold distinction in consciousness from the Analyses (Sect. 3) and relate that back to the issue of objectivity in the debate (Sect. 4). I end by suggesting how this three-fold model from the Analyses helps us preserve the essentially tripartite structure (as Brough and Sokolowski insist we do) while not making one of these levels the object of another (in keeping with Zahavi’s critique) (Sect. 5). This essay argues that Richard Kearney’s philosophical work has something important to say to phenomenological psychology and, in turn, has something important to learn from it. It begins by highlighting a movement of return after deconstruction, consistent throughout Kearney’s oeuvre, that emerges clearly in the recently published Imagination Now collection—which contains some of Kearney’s most important writings. It then shows how this movement is a fundamentally therapeutic endeavor. A quick review of several recent volumes about Kearney’s work makes clear how (...) his philosophy suggests an embodied and not simply a linguistic approach to therapy. As such, a certain phenomenological psychology is revealed as being implicitly operative in Kearney’s work. The essay then ends by highlighting three possible benefits of having phenomenological psychologists engage with Kearney’s work: a revaluation of the non-cognitive aspects of subjective constitution, a renewed look at the role of both the narrative and carnal dimensions in psychological research and psychotherapy, and an even more enhanced socio-cultural role for phenomenological psychology. This paper closely examines Strauss’ conception of “Medieval Enlightenment”. It focuses on the central role that Arab philosophy has played in the development of Strauss’s thought and discusses the validity of the uses he makes of it. It also emphasizes the interest of Strauss’s analyses as regards Arab philosophy while drawing attention to the tensions they create. It claims that Strauss’ involvement in the quarrel between Ancients and Moderns aims at showing that medieval philosophy cannot be reduced simply to the (...) effort to reconcile philosophy and religion. The ideas of some Arab philosophers cropped up throughout Strauss’s philosophical development and determined his interpretation of Maimonides and Plato as well as his stance in opposition to the moderns. However Strauss’s idea of the “medieval Enlightenment” remains fundamentally ambiguous. Is that Enlightenment supposed to be an argument for the preservation of faith alongside reason or does it rather express a kind of atheism or disguised materialism? (shrink)

With his Logic of Incarnation, James K. A. Smith has provided a compelling critique of the universalizing tendencies in some strands of postmodern philosophy of religion. A truly postmodern account of religion must take seriously the preference for particularity first evidenced in the Christian account of the incarnation of God. Moving beyond the urge to universalize, which characterizes modern thought, Smith argues that it is only by taking seriously particular differences--historical, religious, and doctrinal--that we can be authentically religious and authentically (...) postmodern. Smith remains hugely influential in both academic discourse and church movements. This paper develops a phenomenological account of spirituality that can help us think more broadly and deeply about religion and its role in our lives. It begins by explaining spirituality as a supra-subjective force that shapes a sub­ject’s intuitive engagement with the world (Section I). Then, it shows that such a spirituality is affective in (and affected by) cultural expression (Section II), by way of historically situated institutions or traditions [Stiftungen] (Section III). The last step of the paper will be (...) to connect this account of spirituality to our understanding of religion by articulating four distinct levels of phenomenological analysis that will have emerged in the discussion of spirituality and showing that each of these levels must be accounted for in a distinct way if we want to offer a full-fledged philosophy of religion (Section IV). In so doing, we will see that this account of spirituality potentially helps us see a broader range of things that could count as “religious,” in part by helping us see that religion is a particular mode of expressing the spirituality that operates as the deepest motivating impulse driving our lives. En dégageant dans l’analyse du remplissement de Husserl l’importance de la directionalité inhérente de la protention et sa capacité à distinguer entre les modes clarifiant et confirmant de l’intuition, l’avant-dernière section de cet article montre une fois pour toutes ce qui distingue la protention de la rétention. La différence n’est pas simplement une différence de direction, mais aussi de fonction essentielle. Enfin, l’auteur avance pour terminer qu’en échouant à reconnaître le rôle unique de la protention, on prend le risque non seulement de comprendre incorrectement la protention, mais aussi de rendre compte de la rétention elle-même de manière erronée, qui empêche d’apprécier avec exactitude ce qui est innovant dans l’analyse husserlienne de la conscience interne du temps. Given the resurgence of eschatological thought in contemporary theology and the continued relevance of phenomenology in philosophy, this book brings together leading thinkers such as Lacoste, Romano, Kearney and Hart to explore the ways in which these two seemingly unrelated disciplines illuminate each other. Through a series of phenomenological analyses of key eschatological concepts and detailed readings in some of the key figures of both disciplines, this text reveals that phenomenology and eschatology are fundamentally inter-related, and that neither can be (...) fully understood without the other: without eschatology, phenomenology would not have developed the ethical and temporal aspects that characterize it today; without phenomenology, eschatology would remain relegated to the sidelines of serious theological discourse. The next steps in health reform, like all such efforts before it, will have to engage the issue of American health care federalism – the relationship between the federal and state governments in the realm of health law and policy. Since its enactment in 2010, the Patient Protection and Affordable Care Act has offered a robust example of modern federalism and revealed new complexities. This article recounts the findings of our five-year study of the federalist and nationalist features of ACA (...) implementation. Contrary to the claims of ACA opponents that the law marked a federal “takeover,” the ACA's governance structures have advanced rather than suppressed state power. But we also found that the advances in state power occurred seemingly independently of the statute's structural arrangements; that is, the ACA's nationalist and federalist features both enhanced state power over health policy. These findings raise questions about whether cherished American federalism values are unique to federalist structures; they also raise the question of what exactly health care federalism is for, and why we continue to design health policy with federalism front and center. It is not clear that enhanced state power has brought better health policy. If it has not, is federalism for its own sake worth the trade-off? (shrink)

Protention is often understood as being equivalent to retention but functioning in the other (future) direction. This, I would argue, has prevented a full appreciation of protention’s importance to phenomenological scholarship. In this paper, I will elucidate Husserl’s positive account of protention. I will argue that the view that protention is like retention, but in the other direction, is insufficient. Abandoning this negative view, I will explain what is unique about protention, and how it helps make sense of such key (...) phenomenological concepts as fulfillment, passive intentionality, and self-constitution. Cependant, pour mieux le comprendre de cette façon, nous devons d’abord reconcevoir ce que Levinas veut dire par “l’éthique”, pour voir la continuité essentiel de ses comptes de subjectivité et temporalité. Litigation cannot solve a public health crisis. But litigation can be an effective complementary tool to regulation by increasing the salience of a public health issue, eliciting closely guarded information to move public opinion, and prompting legislative action. From tobacco to opioids, litigants have successfully turned to courts for monetary relief, to initiate systemic change, and to hold industry accountable For years, litigators have been trying to push firearm suits into their own litigation moment. But litigation against the gun industry (...) poses special challenges. Not only has the regulatory regime failed to prevent a public safety hazard, Congress has consistently underfunded and understaffed the relevant regulatory actors. And in 2005 it legislatively immunized the gun industry from suit with the Protection of Lawful Commerce in Arms Act. This paper surveys the field of litigation in response to gun violence, tracking the limited successes of victims and stakeholders suing the gun industry. We find that victories remain confined to individual actors and unlike high-impact public litigations in other areas, aggregate class actions and major public litigation led by state attorneys general are noticeably absent in the firearm context. At once provocative and inspiring_, Against the Flow_ is a work of polemic from an internationally respected writer and thinker on arts education. Peter Abbs argues that contemporary education ignores the aesthetic and ethical as a result of being in thrall to such forces as the market economy and managerial and functional dictates. He identifies the present education system as being inimical to creativity and authentic learning and instead, narrowly focused on the quantitative measuring of results. This absence of a (...) creative and ethical dimension in education has implications for art making in wider society. Art is shown as emerging from, and appealing to, the ironic postmodernist sensibility and mass media-led culture, while being devoid of philosophical significance. This book opens up a fresh and timely debate about the vital power of creativity in modern education. Drawing on examples from modern poetry, literature and visual art, it is an eloquent and passionate argument for the need to develop ethical and aesthetic energies to confront the growing vacuity of contemporary culture. Focusing on clothing and adornment (dress), this worldwide cross-cultural comparison asks why people in some societies appear to dress in uniform or standardized ways, whereas in other societies individuals display considerable variability in dress. The broader research question is why some societies have more within-group variation than others. Hypotheses are tested on 80 societies drawn from the Standard Cross-Cultural Sample (SCCS). The central hypotheses consider the impact of general societal tightness or looseness, degree of egalitarianism as well as other aspects (...) of societal complexity, and the role of resource stress on dress standardization. Exploratory methods identify four latent constructs of dress from newly coded variables, one latent construct for tightness/looseness, and one latent construct for resource stress. As expected, (1) increased societal tightness was positively related to increased standardization and rules regarding dress and (2) increased resource stress is generally related to more standardization of dress and rules regarding adornment. However, contrary to theoretical expectations, the predictors of tightness–looseness differ from the predictors of dress. Most importantly, resource stress negatively predicts tightness but positively predicts three of the latent dress constructs. The relationship between dress standardization and societal complexity may be curvilinear, with mid-range societies having more standardization. Although some of the theorized relationships are supported (including that standardization of dress is predicted by societal tightness and more resource stress), at the end of paper we discuss some puzzling findings, speculate about possible explanations, and suggest further lines of research.
